1. Veranstalter

Veranstalter dieses Gewinnspiels ist die SellerX Commerce GmbH, c/o
SellerX Germany GmbH, Chausseestr. 19, 10115 Berlin, VAT DE287373074 (im
Folgenden „Veranstalter“).

 

2. Geltung

Diese Teilnahmebedingungen regeln die Teilnahme an dem Gewinnspiel
„Phone-Cases-Verlosung“ im Rahmen der Aktion „kwmobile Giveaway Marathon“ (im
Folgenden „Gewinnspiel“). Mit der Teilnahme akzeptiert der Teilnehmer diese
Teilnahmebedingungen verbindlich.

Das Gewinnspiel wird als eigenständiges Einzel-Gewinnspiel mit eigener
Teilnahme und eigener Auslosung durchgeführt. Die Bezeichnung „Giveaway
Marathon“ dient ausschließlich der kommunikativen Klammer; eine Übertragung
von Teilnahmen auf andere Gewinnspiele oder die Bildung gemeinsamer Lose
findet nicht statt.

 

3. Teilnahmeberechtigung

Teilnahmeberechtigt sind ausschließlich natürliche Personen, die

•     zum Zeitpunkt der Teilnahme das 18. Lebensjahr vollendet haben,

•     ihren Wohnsitz oder gewöhnlichen Aufenthalt in der Bundesrepublik Deutschland
haben,

•     über einen aktiven persönlichen Instagram-Account verfügen, der nicht gegen die Nutzungsbedingungen von Instagram verstößt.

Von der Teilnahme ausgeschlossen sind:

•     Mitarbeiter und Beauftragte des Veranstalters und mit ihm verbundener Unternehmen sowie
deren Angehörige im Sinne des § 15 AO,

•     gewerbliche Gewinnspieldienste, Gewinnspielvereine und vergleichbare Dritte,

•     Personen, die zur Teilnahme automatisierte Verfahren, Bots oder mehrere
Instagram-Accounts einsetzen oder die Teilnahmebedingungen anderweitig
manipulieren.

 

4. Teilnahmezeitraum

Der Teilnahmezeitraum dieses Gewinnspiels beginnt am 19.06.2026 um 18:00 Uhr und
endet am 25.06. um 23:59 Uhr. Die Auslosung erfolgt am Freitag, 26.06.2026 bzw. zeitnah danach. Maßgeblich für die Rechtzeitigkeit ist der Eingang des Kommentars (FARBE) unter dem zugehörigen Instagram-Post auf @_kwmobile

5. Teilnahme und Mechanik

5.1 Teilnahme

Die Teilnahme erfolgt durch:

•     Folgen des Instagram-Accounts @_kwmobile spätestens zum Zeitpunkt der Auslosung;

•     Kommentar des Keywords FARBE unter dem zugehörigen Instagram-Post innerhalb des
Teilnahmezeitraums;

•     Bestätigung der Teilnahme über die Superchat-Direktnachricht innerhalb des
Teilnahmezeitraums sowie Angabe von Smartphone-Modell und Wunschfarbe.

5.2
Manipulation

Die Verwendung mehrerer Accounts, automatisierter Tools oder sonstige
Manipulationsversuche führen zum Ausschluss von der Teilnahme.

 

6. Gewinne

6.1 Gewinn

Verlost werden 2 (zwei) Gewinner mit je 2 (zwei) kwmobile-Hüllen. Modell, Farbe und Marktwert werden in der zugehörigen Postbeschreibung ausgewiesen. Marktwert befindet sich ungefähr zwischen 15,00€ und 30,00€ [finaler Wert hängt von Modell & Farbauswahl des Gewinners ab].

6.2 Gemeinsame Bestimmungen

Eine Auszahlung der Gewinne in bar, ein Tausch oder eine Übertragung
an Dritte sind ausgeschlossen. Der Versand der Sachgewinne erfolgt
ausschließlich an Adressen innerhalb Deutschlands und ist für den Gewinner
kostenfrei.

 

7. Gewinnermittlung

7.1 Auslosung

Es werden zwei Gewinner unter allen gemäß Ziffer 5 gültig
teilnehmenden Personen per Zufallsauswahl ermittelt; je Gewinner werden zwei
Hüllen vergeben. Die Auslosung erfolgt zeitnah nach Ablauf des
Teilnahmezeitraums.

7.2 Dokumentation der Auslosung

Die Auslosung wird vom Veranstalter intern dokumentiert. Eine
zusätzliche Veröffentlichung in Form einer Live-Übertragung oder einer
Bildschirmaufzeichnung eines anerkannten Zufallsgenerators (z. B. random.org)
bleibt dem Veranstalter vorbehalten.

 

8. Gewinnbenachrichtigung und
Versand

Die Gewinner werden innerhalb von sieben (7) Tagen nach der Auslosung
per Instagram-Direktnachricht (über Superchat) benachrichtigt. Der Gewinner
ist verpflichtet, innerhalb von sieben (7) Tagen nach Zugang der
Gewinnbenachrichtigung die für den Versand erforderlichen Daten (Name,
Lieferanschrift) mitzuteilen.

Erfolgt innerhalb dieser Frist keine Antwort, verfällt der Anspruch
auf den Gewinn. Der Veranstalter ist in diesem Fall berechtigt, einen
Ersatzgewinner zu ermitteln.

 

9. Veröffentlichung des
Gewinnernamens

Mit der Teilnahme erklärt der Teilnehmer sein Einverständnis, dass im
Falle eines Gewinns sein Instagram-Handle und/oder sein Vorname mit dem
Anfangsbuchstaben des Nachnamens auf dem Account @_kwmobile sowie auf der
Aktionsseite des Veranstalters bekannt gegeben werden dürfen. Diese
Einwilligung ist freiwillig und kann jederzeit mit Wirkung für die Zukunft
widerrufen werden, ohne dass dies Auswirkungen auf die Teilnahme oder den
Gewinn hat.

 

10. Haftung

Die Gewinne werden im Wege der Schenkung gewährt. Die Haftung des
Veranstalters für Sachmängel der Gewinne ist nach §§ 521, 524 BGB beschränkt;
der Veranstalter haftet insoweit nur für Vorsatz, grobe Fahrlässigkeit sowie
für arglistig verschwiegene Mängel.

Eine Haftung des Veranstalters nach dem Produkthaftungsgesetz, für die
schuldhafte Verletzung von Leben, Körper oder Gesundheit sowie für Vorsatz
und grobe Fahrlässigkeit bleibt von den vorstehenden Beschränkungen
unberührt.

Im Übrigen ist die Haftung des Veranstalters für leicht fahrlässige
Pflichtverletzungen ausgeschlossen, es sei denn, eine wesentliche
Vertragspflicht (Kardinalpflicht) ist betroffen. In diesem Fall ist die
Haftung der Höhe nach auf den vertragstypischen, vorhersehbaren Schaden
begrenzt.

Der Veranstalter haftet nicht für technische Störungen außerhalb
seines Verantwortungsbereichs (insbesondere Störungen der Plattform Instagram
oder der Superchat-Infrastruktur), die die Teilnahme oder die
Gewinnbenachrichtigung beeinträchtigen.

 

11. Datenschutz

11.1
Verantwortlicher

Verantwortlicher im Sinne der DSGVO ist der unter Ziffer 1 genannte Veranstalter.

11.2 Verarbeitete Daten und Zwecke

Im Rahmen der Teilnahme verarbeitet der Veranstalter:

•     Instagram-Handle, Kommentar- und Interaktionsdaten,

•     über Superchat erfasste Angaben (Smartphone-Modell, Wunschfarbe, Folgestatus),

•     bei Gewinn zusätzlich: Vor- und Nachname, Lieferanschrift.

Die Verarbeitung erfolgt zur Durchführung des Gewinnspiels (Art. 6
Abs. 1 lit. b DSGVO), zur Aufdeckung und Abwehr von Manipulationsversuchen
(Art. 6 Abs. 1 lit. f DSGVO) sowie – im Falle der Veröffentlichung des
Gewinnernamens nach Ziffer 9 – auf Grundlage der Einwilligung des Teilnehmers
(Art. 6 Abs. 1 lit. a DSGVO).

11.3 Empfänger und Auftragsverarbeitung

Zur technischen Durchführung des Gewinnspiels werden personenbezogene
Daten an folgende Auftragsverarbeiter übermittelt:

Die Verarbeitung erfolgt innerhalb der EU; eine Übermittlung in ein
Drittland findet nicht statt.

11.4 Speicherdauer

Die Daten der Teilnehmer werden spätestens vier (4) Wochen nach der
Auslosung gelöscht. Daten der Gewinner werden zur Erfüllung steuer- und handelsrechtlicher Aufbewahrungspflichten für die gesetzlich vorgeschriebene Dauer gespeichert.

11.5 Rechte der Betroffenen

Den Teilnehmern stehen die Rechte auf Auskunft (Art. 15 DSGVO),
Berichtigung (Art. 16 DSGVO), Löschung (Art. 17 DSGVO), Einschränkung der
Verarbeitung (Art. 18 DSGVO), Datenübertragbarkeit (Art. 20 DSGVO) und Widerspruch (Art. 21 DSGVO) zu, ferner das Recht auf Beschwerde bei einer Datenschutzaufsichtsbehörde.

12. Vorzeitige Beendigung und
Änderung

Der Veranstalter behält sich das Recht vor, das Gewinnspiel jederzeit
ohne Vorankündigung abzubrechen, zu unterbrechen oder zu ändern, soweit dies
aus technischen, rechtlichen oder organisatorischen Gründen erforderlich ist
und den Teilnehmern unter Berücksichtigung ihrer Interessen zumutbar ist.
Insbesondere im Fall einer wesentlichen Beeinträchtigung der ordnungsgemäßen
Durchführung (z. B. durch Manipulation, Software- oder Hardwarefehler) ist
der Veranstalter zur Beendigung berechtigt.

 

13. Disqualifikation

Der Veranstalter ist berechtigt, Teilnehmer bei Verstoß gegen diese
Teilnahmebedingungen, bei Manipulationsversuchen oder bei sonstigem rechts-
oder sittenwidrigem Verhalten von der Teilnahme auszuschließen und – sofern
bereits ein Gewinn zugesprochen wurde – diesen zurückzufordern.

 

14. Hinweis zu Instagram / Meta

Das Gewinnspiel steht in keiner Verbindung zu Meta Platforms Ireland
Ltd. (Instagram) und wird von Meta in keiner Weise gesponsert, unterstützt
oder organisiert. Sämtliche Anfragen, Kommentare oder Beschwerden im
Zusammenhang mit dem Gewinnspiel sind ausschließlich an den Veranstalter zu
richten. Mit der Teilnahme stellt der Teilnehmer Meta von jeglichen
Ansprüchen im Zusammenhang mit dem Gewinnspiel frei.

 

15. Schlussbestimmungen

Es gilt das Recht der Bundesrepublik Deutschland unter Ausschluss des
UN-Kaufrechts. Soweit gesetzlich zulässig, ist Erfüllungsort und
ausschließlicher Gerichtsstand der Sitz des Veranstalters.

Sollte eine Bestimmung dieser Teilnahmebedingungen unwirksam sein oder
werden, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt. An die
Stelle der unwirksamen Bestimmung tritt diejenige wirksame Bestimmung, die
dem mit der unwirksamen Bestimmung verfolgten wirtschaftlichen Zweck am
nächsten kommt.

Der Rechtsweg ist ausgeschlossen.

Organizer

The organizer of this giveaway is SellerX Commerce GmbH, c/o SellerX
Germany GmbH, Chausseestr. 19, 10115 Berlin, VAT DE287373074 (the
“Organizer”).

 

2.
Scope

These terms govern participation in the giveaway “Phone Cases
Giveaway” within the “kwmobile Giveaway Marathon” campaign (the “Giveaway”).
By entering, the participant accepts these terms and conditions as binding.

The Giveaway is run as a
standalone single giveaway with its own entry and its own draw. The term
“Giveaway Marathon” serves solely as a communicative umbrella; entries are
not transferred to other giveaways and no shared ticket pool is formed.

 

3.
Eligibility

Participation is open
exclusively to natural persons who:

•    
are
at least 18 years old at the time of entry,

•    
have
their place of residence or habitual abode in the Federal Republic of
Germany, and

•    
have
an active personal Instagram account that does not breach Instagram's terms
of use.

Excluded from
participation are:

•    
employees
and agents of the Organizer and its affiliated companies, and their relatives
within the meaning of § 15 AO (German Tax Code),

•    
commercial
sweepstakes services, sweepstakes clubs, and comparable third parties,

•     persons
using automated tools, bots or multiple Instagram accounts, or otherwise
manipulating these terms.

 

4.
Participation Period

The
participation period for this giveaway begins on June 19, 2026, at 6:00 p.m. and
ends on June 25 at 11:59 p.m. The draw takes place on Friday, 26 June 2026 or
shortly thereafter. The relevant time for entry is when the comment is
received under the corresponding Instagram post on @_kwmobile.

5.
Entry and Mechanics

5.1 Entry

To enter, the participant
must:

•    
follow
the Instagram account @_kwmobile no later than the time of the draw;

•    
comment the keyword FARBE under the
corresponding Instagram post within the participation period; and

•     confirm
the entry via Superchat direct message within the participation period,
indicating their smartphone model and preferred case color.

5.2
Manipulation

The use of multiple
accounts, automated tools, or other attempts at manipulation will result in
exclusion from the Giveaway.

 

6.
Prizes

6.1 Prize

The
giveaway awards [2 (two) winners with
2 (two) kwmobile cases each – confirm the “2x2” interpretation]. The
model, color and retail value are specified in the corresponding Instagram
post description The market value is approximately between €15.00 and €30.00
[the final value depends on the winner's choice of model and color].

6.2
Common Provisions

Cash payment, exchange, or
transfer of prizes to third parties is excluded. Physical prizes will only be
shipped to addresses within Germany, free of charge to the winner.

 

7.
Selection Process

7.1 Draw

Two winners are selected
by random draw from all valid entries under Section 5; each winner receives
two cases. The draw takes place shortly after the close of the participation
period.

7.2 Documentation
of the Draw

The draw is documented
internally by the Organizer. The Organizer reserves the right to additionally
publish the draw via a live broadcast or a screen recording of a recognised
random number generator (e.g. random.org).

 

8.
Winner Notification and Shipping

Winners will be notified within seven (7) days after the draw by
Instagram direct message (via Superchat). The winner is required to respond
within seven (7) days of receipt of the notification with the shipping
details (name, delivery address).

If no response is received
within this period, the claim to the prize lapses. The Organizer may then
select a replacement winner.

 

9.
Publication of Winner's Name

By entering, the participant agrees that, in the event of winning,
their Instagram handle and/or first name plus the initial of their last name
may be published on the @_kwmobile account and on the Organizer's campaign
landing page. This consent is voluntary and can be revoked at any time with
effect for the future, without any impact on participation or the prize
itself.

 

10.
Liability

The prizes are granted as
a gift (Schenkung) under German law. The Organizer's liability for
material defects in the prizes is limited under §§ 521, 524 BGB; in this
respect the Organizer is liable only for intent, gross negligence, and
fraudulently concealed defects.

The Organizer's liability under the German Product Liability Act
(ProdHaftG), for culpable injury to life, body or health, and for intent and
gross negligence, remains unaffected by the above limitations.

In all other respects, liability for slightly negligent breaches of
duty is excluded, unless a material contractual obligation (Kardinalpflicht)
is affected. In that case, liability is limited in amount to the typical
foreseeable damage.

The Organizer is not liable for technical disruptions outside its
sphere of responsibility (in particular Instagram platform or Superchat
infrastructure outages) that affect participation or winner notification.

 

11.
Data Protection

11.1 Controller

The controller within the
meaning of the GDPR is the Organizer named in Section 1.

11.2
Data Processed and Purposes

In connection with participation,
the Organizer processes:

•    
Instagram
handle, comment and interaction data,

•     data
collected via Superchat (smartphone model, preferred color, follow status),

•    
for
winners additionally: first and last name, delivery address.

Processing is carried out
for the performance of the giveaway (Art. 6(1)(b) GDPR), for the detection
and prevention of manipulation (Art. 6(1)(f) GDPR), and – for the publication
of the winner's name under Section 9 – on the basis of the participant's consent
(Art. 6(1)(a) GDPR).

11.3
Recipients and Processors

For the technical
operation of the giveaway, personal data is transferred to the following
processors:

Processing takes place within the EU; no transfer to a third country occurs.

11.4
Retention

Participant data will be deleted no later than four (4) weeks after
the draw. Winner data will be retained for the period required by tax and
commercial retention obligations.

11.5
Data Subject Rights

Participants have the
rights of access (Art. 15 GDPR), rectification (Art. 16 GDPR), erasure (Art.
17 GDPR), restriction of processing (Art. 18 GDPR), data portability (Art. 20
GDPR) and objection (Art. 21 GDPR), as well as the right to lodge a complaint
with a supervisory authority.

Data protection requests
should be addressed to privacy@sellerx.com.

 

12.
Early Termination and Amendment

The Organizer reserves the right to terminate, suspend, or modify the
giveaway at any time without prior notice where this is necessary for
technical, legal or organisational reasons and is reasonable for participants
taking their interests into account. In particular, the Organizer is entitled
to terminate the giveaway in the event of material disruption to its proper
conduct (e.g. through manipulation, software or hardware errors).

 

13.
Disqualification

The Organizer may exclude participants from the giveaway in the event
of breach of these terms, attempted manipulation, or other unlawful or
unethical conduct, and may reclaim any prize already awarded.

 

14.
Instagram / Meta Notice

This giveaway is in no way connected to Meta Platforms Ireland Ltd.
(Instagram) and is not sponsored, endorsed, or administered by Meta. All
inquiries, comments or complaints relating to the giveaway must be directed
exclusively to the Organizer. By entering, the participant releases Meta from
any claims connected with the giveaway.

 

15.
Final Provisions

These terms are governed by the laws of the Federal Republic of
Germany, excluding the UN Convention on Contracts for the International Sale
of Goods. To the extent permitted by law, the place of performance and
exclusive jurisdiction is the registered office of the Organizer.

Should any provision of
these terms be or become invalid, the validity of the remaining provisions
shall remain unaffected. The invalid provision shall be replaced by the valid
provision that most closely approximates the economic purpose pursued by the
invalid provision.

Recourse to legal
proceedings is excluded.
